New European Pact on Migration and Asylum
On May 14, the European Parliament and the Council of the European Union approved Regulation (EU) 2024/1348, introducing the new European Pact on Migration and Asylum. Within this framework, the new border procedure, along with the solidarity mechanism between first arrival countries and others, forms the core of the reform.
By the Implementing Decision (EU) 2024/2150 of the Commission, dated August 5, 2024, which sets out the application modalities of Regulation (EU) 2024/1348 concerning the adequate capacity of Member States and the maximum number of applications that a Member State is required to examine under the border procedure each year, it has been established that Italy will be able to examine a maximum of 16,032 asylum applications under the border procedure from June 12, 2026, to June 12, 2027, the highest quota in the entire EU at 26.7% of the total. From June 13, 2027, to October 14, 2027, Italy will be able to examine a maximum of 24,048 asylum applications under this procedure.
Once the quota of applications to be examined is reached, the solidarity mechanism is triggered.
Following Italy, Hungary will have the next highest quota with 15,432 requests to analyze between June 2026 and June 2027 and 23,148 the following year. Spain follows with respectively 6,602 and 9,903 annual requests to examine, Greece (4,376 and 6,564), and Poland (3,128 and 4,692).
Regulation (EU) 2024/1348 will replace the Asylum Procedures Directive, introducing mandatory border procedures for certain categories of applicants with the aim of rapidly assessing at the EU's external borders whether applications are unfounded or inadmissible. Individuals subject to the border asylum procedure are not authorized to enter the territory of the Member State. The Regulation provides for adequate capacity in each Member State, in terms of reception and human resources, to examine a certain number of applications under the border procedure at any time. The adequate capacity at EU level has been set at 30,000.
The adequate capacity of each Member State has been established based on a formula that takes into account the following elements: the number of irregular border crossings, arrivals following search and rescue operations, and pushbacks over a three-year period.
Priority will be given to applicants who are more likely to be repatriated, pose a security risk, and are not minors or family members.
The regulation on asylum and migration management will fully come into force only in June 2026.
